notinmycloud.com provides a self-hosted file-sharing service powered by Pingvin Share, an open-source platform. This service is offered free of charge on an as-is basis for temporary file transfers.

1. Nature of the Service

This is a temporary, best-effort file-sharing tool only.
Files are stored on servers operated by notinmycloud.com until they expire (based on settings chosen by the uploader) or are manually deleted.
We do not guarantee permanent storage, availability, or recovery of any uploaded files.
The service is provided for lawful, personal, or business-related file transfers only.

2. Use at Your Own Risk

You acknowledge and agree that:

You use this service entirely at your own risk.
notinmycloud.com makes no warranties of any kind (express or implied) regarding uptime, data integrity, security, or availability.
We are not responsible for any loss, damage, corruption, deletion, or inaccessibility of your files — including but not limited to hardware failures, software bugs, maintenance, cyberattacks, or any other event that may cause data loss or service interruption.
Even if files are lost permanently (e.g., due to hard drive failure, hacking, or system crash), notinmycloud.com shall have no liability whatsoever.

3. No Liability for User Content or Actions

You are solely responsible for the content you upload, share, or download.
You must not use the service for any illegal, harmful, abusive, or unauthorized purposes (including but not limited to distributing malware, copyrighted material without permission, or illegal content).
notinmycloud.com is not liable for any consequences arising from your use of the service, including any legal claims, damages, or issues related to the files you share or receive.
We reserve the right to remove any content or terminate any share without notice if we believe it violates these terms or applicable laws.

4. Data Collection and Privacy

We do not actively collect personal information beyond what is technically necessary to operate the service (e.g., IP addresses in server logs for abuse prevention, temporary metadata about shares).
Uploaded files are not end-to-end encrypted by default in this Pingvin Share instance (the server can technically access file contents). If you require encryption, encrypt files on your device before uploading.
We do not sell, share, or misuse any data. Logs and shares are deleted automatically according to expiry settings.
No accounts are required for basic use, so we do not store user profiles unless you explicitly register one.

5. Limitation of Liability

To the fullest extent permitted by law:

notinmycloud.com, its operators, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages — including but not limited to loss of data, revenue, or privacy — even if advised of the possibility of such damages.
Our total liability in any circumstance is limited to $0.

6. Changes to This Policy

We may update this Privacy Policy at any time. Continued use of the service after changes constitutes acceptance of the new terms.
